Background and Interpretation

These Terms and Conditions (Terms) apply to any use of the Public Services for commercial purposes including but not limited to the transmission of sound, images, video or other content (Broadcast) by any person (including its employees, agents or contractors, if any) (Broadcaster).

Agreement

The Broadcaster acknowledges and agrees that:

(a) its access to the Public Services is at all times at the discretion of Eventfinda Stadium;

(b) Eventfinda Stadium may at any time reduce, throttle or terminate the bandwidth, connectivity, connection, or any other aspect of the Public Services for any reason at its sole discretion, including to prioritise its own internet usage requirements;

(c) its access to the Public Services may be blocked, suspended, or terminated at any time for any reason including, but not limited to, violation of any of these Terms, and any actions that may lead to liability for Eventfinda Stadium or its owners, disruption of access to other users or networks, and violation of applicable laws or regulations;

(d) it accepts all of these Terms each time it uses the Public Services and it is its responsibility to review these Terms for any changes each time it uses the Public Services;

(e) Eventfinda Stadium reserves the right to revise any of these Terms at any time.

Broadcaster access to the Public Services is conditional upon the legal, proper and responsible use of the Public Services. By using the Public Services, the Broadcaster agrees that all activities conducted online through the Public Services shall not violate any applicable law or regulation or the rights of Eventfinda Stadium, or any third party.

Disclaimer

The Broadcaster acknowledges and accepts that:

(a) the Public Services may not be uninterrupted or error-free and that there may be areas within the Eventfinda Stadium premises which have reduced or no access to the Public Services;

(b) Eventfinda Stadium does not guarantee the speed, frequency, bandwidth, or any other technical aspect of the connection of the Public Services;

(c) that Eventfinda Stadium is only providing the Public Services. The Public Services do not contain inherent anti-virus, malware, or firewall protection any computer or other internet-connect device. The Broadcaster remains responsible at all times for the security of its device(s) and should take measures to ensure the security of its wireless connection through methods such as encryption, firewalls and anti-virus software;

(d) connection to the Public Services may be subject to capacity restrictions and networking ability of its computer or internet-connected device; and

(e) that the Public Services are provided on an “as is” and “as available” basis without warranties of any kind.

Support

5.1

In the event that the Broadcaster requests technical assistance in relation to its use of the Public Services:

(a) Eventfinda Stadium may elect to provide technical assistance (Support) at its sole discretion, but does not guarantee or warrant that technical assistance will be provided or available in any instance; and

(b) in the event that Eventfinda Stadium is requested to, and does, provide Support in relation to its use of the Public Services the Broadcaster agrees:

(i)  that to the fullest extent permitted by law, no warranties or guarantees or other terms are to be implied into these Terms in relation to any Support provided, including under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Contract and Commercial Law Act 2017 or otherwise;

(ii) to pay $165.00 per hour per person providing the Support within 7 days of invoicing.
