Vendor Conditions
EVENTFINDA STADIUM EXTERNAL FOOD VENDOR TERMS AND CONDITIONS
These Terms and Conditions (“Terms”) govern the relationship between the entity managing Eventfinda Stadium (“Venue Management” or “Licensor”) and the external food and beverage vendor (“Vendor” or “Licensee”) granted permission to operate at Eventfinda Stadium (the “Venue”) for a specific Event or period.
By applying to become a vendor, signing an agreement to operate, or setting up operations on Venue premises, the Vendor accepts and agrees to be bound by these Terms.
1. Definitions
“Agreement” means the contract formed between Venue Management and the Vendor, incorporating these Terms and any specific booking confirmation or accepted quote.
“Authorised Products” means the specific food and beverage items the Vendor is permitted to sell, as approved in writing by Venue Management.
“Event” means the specific occasion(s) for which the Vendor has been engaged to provide services at the Venue.
“Vendor” includes food trucks, pop-up stalls, trailers, carts, and their staff, agents, and contractors.
2. Grant of License
2.1. Venue Management grants the Vendor a non-exclusive, revocable license to occupy a designated space at the Venue for the sole purpose of selling Authorised Products during agreed operational hours.
2.2. This license does not create a tenancy relationship. Venue Management retains full possession and control of the premises.
3. Compliance and Regulatory Obligations

3.1. Food Safety & Hygiene: The Vendor must comply strictly with the Food Act 2014 and all relevant regulations. The Vendor warrants that they currently hold a valid registration under a Food Control Plan or National Programme and must display proof of this registration prominently at their stall or truck at all times.
3.2. Auckland Council Regulations: The Vendor is solely responsible for obtaining and complying with all necessary permits, licenses, bylaws, and environmental health standards required by Auckland Council for mobile trading or temporary food stalls. This includes, but is not limited to, noise restrictions, waste disposal bylaws, and health standards.
3.3. Health and Safety at Work Act 2015: The Vendor must comply with their duties under this Act to ensure the health and safety of their workers, event attendees, and Venue staff. The Vendor must adhere to site-specific safety inductions provided by Venue Management.
3.4. Venue Management and Auckland Council environmental health officers reserve the right to inspect the Vendor’s operation at any time. Failure to comply with health and safety standards may result in immediate closure of the Vendor’s operations without compensation.
4. Sustainability and Packaging Policy
Crucial to your request: This section addresses the compostable packaging requirement.
4.1. Eventfinda Stadium is committed to sustainable event practices. It is a mandatory requirement that all service-ware and packaging supplied to customers by the Vendor must be certified commercially compostable.
4.2. The use of single-use non-compostable plastics, polystyrene foam containers, plastic straws, plastic cutlery, and non-compostable plastic bags is strictly prohibited.
4.3. Vendors must ensure their packaging meets recognised compostability standards (e.g., AS 4736 or AS 5810). This is to say all packaging must adhere to recycling code 7 or higher.
4.4. Venue Management reserves the right to audit the Vendor’s packaging materials on-site. If non-compliant packaging is found, the Vendor may be instructed to cease trading immediately until compliant packaging is sourced, without compensation for lost trade.
4.5 Venue Management reserves the right to charge, and the vendor agrees to pay and remain personally liable for any applicable penalty of up to $1,000 +GST for breaching the sustainability and competititon requirements of this agreement.
5. Approved Products and Non-Competition
Crucial to your request: This section addresses competition with the venue.
5.1. Menu Approval: Prior to the Event, the Vendor must submit a complete proposed menu and price list to Venue Management for approval.
5.2. Non-Competition: To ensure a diverse offering and protect existing venue concessions, Venue Management reserves the sole right to reject any proposed menu item that is deemed to be in direct competition with food or beverages currently sold by Eventfinda Stadium’s internal catering outlets or sponsors.
5.3. Changes: The Vendor may only sell “Authorised Products.” No changes to the approved menu may be made without prior written consent from Venue Management.
5.4. Beverages and Alcohol: Unless specifically authorised in writing, the Vendor is prohibited from selling: a) Alcoholic beverages; b) Commercial bottled water or soft drinks that conflict with the Venue’s exclusive pouring rights sponsors.
6. Liability and Indemnity
Crucial to your request: This section establishes vendor liability.
6.1. The Vendor operates at the Venue entirely at their own risk.
6.2. To the fullest extent permitted by law, Venue Management shall not be liable for any loss of trade, damage to equipment, theft of property, or injury to the Vendor or their staff occurring at the Venue, arising from any cause whatsoever, including power failures, adverse weather, or event cancellation.
6.3. Indemnity: The Vendor agrees to indemnify, defend, and hold harmless Eventfinda Stadium, Venue Management, its related entities, directors, staff, and agents from and against all actions, claims, demands, losses, damages, costs, and expenses (including legal costs on a full indemnity basis) for which they may become liable in respect of:
a) Loss, damage, or injury to property or persons caused or contributed to by the act, omission, negligence, or breach of these Terms by the Vendor, its staff, or agents;
b) Any illness, food poisoning, or allergic reaction arising from products sold by the Vendor; c) Any breach of statutory duty or regulation by the Vendor (including Auckland Council bylaws or the Food Act 2014).
7. Insurance
7.1. The Vendor must hold and maintain a Public Liability Insurance policy with a minimum limit of indemnity of NZ$2,000,000 (Ten Million Dollars) per occurrence.
7.2. A Certificate of Currency for this insurance must be provided to Venue Management prior to entry onto the site.
8. Operations, Site, and Utilities
8.1. Setup and Pack-down: Vendors must adhere strictly to the bump-in and bump-out schedules provided by Venue Management. Vehicles must be moved to designated parking areas immediately after setup.
8.2. Electrical Safety: All electrical equipment brought on-site must hold a current New Zealand electrical “Tag and Test” verification. Venue Management reserves the right to disconnect unsafe equipment.
8.3. LPG Safety: Food trucks or stalls using LPG must comply with relevant gas safety regulations and have current certification for their gas systems.
8.4. Waste Management: While the Venue may provide general event bins, the Vendor is primarily responsible for managing their own back-of-house waste. Vendors must sort waste into appropriate streams (compost, recycling, landfill) as directed by the Venue. Oils and grey water must not be disposed of in Venue drains or on stadium grounds; they must be removed from the site by the Vendor.
8.5 Cleaning: Any additional cleaning required of your site may be charged to you by the venue.
8.5. Staff Conduct: Vendor staff must be presentable, wear appropriate attire (including closed-toe shoes), and conduct themselves in a professional manner at all times. Venue Management reserves the right to request the removal of any staff member behaving inappropriately.
9. Fees and Payment
9.1. Site fees or commission structures will be agreed upon separately in the booking confirmation or contract. 9.2. Failure to pay agreed fees by the due date may result in the cancellation of the Vendor’s license to operate.
10. Termination and Breach
10.1. Venue Management may terminate the Vendor’s license to operate immediately and remove the Vendor from the premises if the Vendor commits a breach of these Terms in the sole opinion of the Venue, including but not limited to breaches of safety regulations, failure to use compostable packaging, or selling unapproved competing products.
10.2. In the event of such termination, the Vendor shall have no claim for compensation or refund of fees or costs against Venue Management.
